3/29/2017 Required Offer of Taken Land Back to Original Owners Proposed Before Judiciary Committee
STATE HOUSE -- During a Judiciary Committee hearing on Tuesday, March 28, 2017, members heard testimony on bill (H-5928) “An Act Relating to State Affairs and Government – Property – Eminent Domain.” This bill requires the state to sell land back to the original owner or heir at acquired price if the land has not been used for 10 years for its original purpose. This is an attempt to lessen the abuse of eminent domain and minimize the effect of Rhode Island Rising also known as Rhode Map Rhode Island.
 
The primary sponsor, Rep. Sherry Roberts (R-District 29, Coventry and West Greenwich), stated “We must return land to the citizens when it is realized that Eminent Domain was not necessary for all, part, or any of a project for one reason or another. Thus, this will minimize the amount of eminent domain land being left without purpose.”
